Online Store Terms (Terms & Conditions of Sale)

These Online Store Terms (“Store Terms”) apply to purchases of physical artworks and related physical goods made through the Moneli online store (“Store”). They do not govern NFT purchases made on third-party marketplaces.
If you are accessing this Store as a consumer in the EEA/UK, mandatory consumer rights under applicable law remain unaffected.

2) Definitions
“Artwork” means a physical work of art (e.g., painting, sculpture, photograph, print) sold through the Store.
“Buyer” means the person placing an order.
“Consumer” means a buyer who qualifies as a consumer under applicable law.
“COA” means Certificate of Authenticity issued for an Artwork (where provided).
“Order” means the Buyer’s purchase request submitted via checkout.
“Contract” means the sales contract concluded as described below.
3) Products and descriptions
A. Uniqueness and variations
Artworks may be unique or limited editions. Images on the Website are for reference; minor variations (e.g., color representation on screens, texture, framing perception) may occur.
B. Availability
We do not guarantee that an Artwork shown as available can be sold immediately. We may refuse an order if the Artwork is no longer available, if there is a pricing error, or for other legitimate reasons.
4) How the contract is formed
A. Placing an order
The Buyer places an Order by completing checkout and confirming acceptance of these Store Terms.
B. Acceptance
The Contract is concluded when we confirm acceptance of the Order by email or when we dispatch the goods.
If we cannot accept an Order, we will inform the Buyer and (if payment was made) arrange a refund.
5) Prices, taxes, and invoices
A. Prices
Prices are shown in: PLN, EUR, GBP, or USD. Unless stated otherwise, prices include applicable taxes: VAT INCLUDED.
B. Shipping costs
Shipping costs are shown at checkout unless otherwise agreed in writing.
C. Invoice/receipt
We provide a VAT invoice or receipt according to applicable law and your configuration.
6) Payment methods
Payment methods are described on the Payment Methods page and may include bank transfer, online payments/cards via a provider, and PayPal.

7) Delivery
A. Delivery area
We deliver to: Worldwide (subject to courier availability and local import regulations).
B. Carriers and insured transport
We may use professional carriers and may require insured shipment for high-value Artworks.
C. Delivery time
Estimated delivery times are provided at checkout or in the order confirmation email. Times may vary due to customs, carrier constraints, or production/packing needs.
D. Risk and inspection
Please inspect the package on delivery. If packaging is visibly damaged, document it (photos) and inform us as soon as possible.
8) Certificate of Authenticity (COA)
A. COA issuance
Where applicable, we provide a COA for the Artwork. The COA is part of the delivered goods.
B. COA and returns
If you return an Artwork, the COA must be returned with it. Missing/damaged COA may affect the refund amount to the extent permitted by law (e.g., diminished value).
9) Right of withdrawal (consumer distance sales)
A. 14-day withdrawal
If you are a Consumer and you purchased via the Store (distance contract), you generally have the right to withdraw within 14 days from delivery without giving any reason.
B. How to withdraw
To withdraw, email contact@moneli.art with an unequivocal statement and include:
order number,
buyer name,
item(s),
delivery date (if known).
C. Return of goods after withdrawal
You must return the goods without undue delay and in any event within: 14 days from the day on which you communicated your withdrawal.
D. Return costs
Unless we state otherwise, the Consumer bears the direct cost of returning the goods.
E. Refunds
We refund payments received from the Consumer, including standard delivery costs (if applicable), using the same payment method unless agreed otherwise.
We may withhold reimbursement until we receive the goods back or the Consumer provides proof of dispatch, whichever occurs first.
F. Consumer handling and diminished value
The Consumer may be responsible for diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
10) Withdrawal exclusions (important)
The withdrawal right does not apply to certain categories of contracts, including:
goods made to order or clearly personalised (e.g., bespoke commissions or custom framing made to the buyer’s specifications),
certain digital content if supplied immediately with the buyer’s express consent and acknowledgment of loss of withdrawal right (if we offer such items).
If an exclusion applies, we will inform you before purchase.
11) Complaints and non-conformity (consumer goods)
A. Legal basis
If the goods are not in conformity with the contract, consumers have rights under applicable consumer law.
B. Practical approach for unique Artworks
Where legally relevant remedies include repair or replacement, please note:
“Repair” may mean restoration or correction where feasible and acceptable without harming the Artwork’s integrity.
“Replacement” may be impossible for unique works. Where replacement is impossible or disproportionate, other remedies (such as price reduction or termination) may apply under applicable law.

requested remedy.
We may request the Artwork be returned for assessment (we will confirm return logistics).
12) Commercial warranties (optional)
If we provide any additional commercial warranty, it will be stated explicitly on the product page or in writing. Commercial warranties do not limit statutory consumer rights.
13) NFTs and third-party marketplaces
A. No NFT sales on the Store
We do not sell NFTs through the Store checkout unless explicitly stated on a specific page.
B. Third-party marketplace transactions
Any NFT purchase is carried out on third-party marketplaces (e.g., OpenSea, Foundation, Crypto.com NFT Marketplace) and is governed by their terms and blockchain network rules. We are not responsible for marketplace availability, smart contract behaviour, wallet providers, gas fees, or third-party fees.
C. Refunds for NFTs
Refunds, cancellations, and dispute processes for NFT purchases are handled under the marketplace’s rules; blockchain transactions may be irreversible and certain fees may be non-refundable.
14) Intellectual property
All Website content remains protected. Purchase of a physical Artwork does not transfer copyright unless expressly agreed in writing. The buyer receives ownership of the physical object only.
15) Personal data
We process personal data in accordance with our Privacy Policy.
16) Accessibility
Our Website Accessibility Statement explains our approach and how to report accessibility issues.
17) Dispute resolution and out-of-court options
A. Contact first
Please contact contact@moneli.art first so we can try to resolve issues.
B. EU ODR platform notice
The former EU Online Dispute Resolution (ODR) platform has been discontinued and is closed. We do not provide an ODR link.
C. Courts and governing law
Governing law: Poland
Jurisdiction: Competent courts of Poland
Mandatory consumer protections remain unaffected.
18) Changes to these Store Terms
We may update these Store Terms by posting a new version on the Website. The version date is shown at the top.
